Terms of Service Addendum

1. Responsibilities

Customer responsibilities:
 
  • Customer must provide all of the necessary information and assistance-related needs for service performance.
Worksup responsibilities:
 
  • Worksup acts as the primary provider of the services, except if outsourcing is done to a third-party vendor.
  • Worksup will communicate with customer if there are scheduled or unscheduled service outages that happen because of maintenance, troubleshooting, disruptions, or as otherwise necessary.

1.1 The Penalties Levied Against the SaaS Provider If Guarantees Are Not Met

Worksup will use commercially reasonable efforts to make the Service available in line with industry standards. If a service malfunctions and does not work as described here, the client is applicable to contact us through email, describe the issue and apply for a potential discount.

2. Services and Capabilities

2.1. Subscription

Worksup provides registered users with the option to enroll in paid plans, granting them the ability to publish their events for attendees to check-in as well as access additional “add-on” features for a specified period (typically 1 month) known as the “Subscription Term.” The subscription is procured on a per-workspace basis. Worksup retains the right to modify the pricing of subscription plans at any time. In the event of a price adjustment, Worksup will publish the updated pricing and make an effort to notify you in advance via email to the address linked with your Worksup user account. Should you choose not to accept the revised pricing, you have the option to terminate your subscription in accordance with the Terms of Service.

2.2. Plans

The basis of a subscription is the Base Plan. If you have an active subscription, you can optionally attach Add-On plans. When you cancel your subscription, all its contained Add-Ons are cancelled, too. Unless explicitly noted, Add-Ons can be attached and removed independently from each other.

2.3. Recurring Charges

By furnishing payment details for your subscription, you agree to pay a non-refundable subscription fee, along with any applicable taxes and service fees (“Subscription Fee”) for your utilization of Worksup. The Subscription Fee will be charged to your credit card or PayPal (the “Payment Method”) at the commencement of your Subscription Term and automatically at the initiation of each subsequent renewal period (the “Renewal Term”) unless you opt to cancel your subscription. The Subscription Fee billed to your Payment Method may fluctuate monthly due to alterations in your subscription plan or applicable taxes, and you explicitly authorize Worksup to debit your Payment Method for this amount.

2.4. Auto-renewals

IF YOU HAVE SUPPLIED PAYMENT INFORMATION TO US FOR THE SERVICES, WE MAY AUTOMATICALLY CHARGE YOU AT THE END OF THE TRIAL OR FOR THE RENEWAL, UNLESS YOU INFORM US OF YOUR INTENTION TO CANCEL YOUR SUBSCRIPTION. The subscription becomes effective from the date of purchase and will automatically renew for a Renewal Term of the same duration unless canceled before the expiration of the Subscription Term or the ongoing Renewal Term.

2.5. Disputes; No Refunds

In the case of billing discrepancies, you waive the right to dispute such discrepancies if not reported to Worksup within 60 days of their initial appearance on a statement. PLEASE NOTE THAT THE SUBSCRIPTION FEE IS NON-REFUNDABLE, AND ALL SALES ARE FINAL. No refund will be issued if your account or subscription is terminated due to a violation of these Terms of Service

THE WORKSUP SUBSCRIPTION IS TIED TO THE ACCOUNT HOLDER AND CANNOT BE TRANSFERRED OR ASSIGNED. YOU ARE RESPONSIBLE FOR ALL INTERNET ACCESS CHARGES. PLEASE CONSULT YOUR INTERNET PROVIDER FOR DETAILS ON POSSIBLE INTERNET DATA USAGE CHARGES. You agree to promptly inform us at support@worksup.com of any unauthorized use related to your subscription or any other security breach.

2.6. Cancellation of Subscription

You have the option to cancel your subscription or trial at any time by logging into your account at www.worksup.com/admin and navigating to the “Pricing & Subscription” page under your workspace name. If you choose to cancel, the termination will take effect at the conclusion of the ongoing Subscription Term or Renewal Term. You will retain access to your subscription for the remaining period, but NO REFUND WILL BE PROVIDED FOR ANY SUBSCRIPTION FEES ALREADY PAID. To avoid paying the Subscription Fee for the upcoming Subscription Term or Renewal Term, you must cancel before the renewal date. Following the cancellation, any outstanding amounts owed under these Terms of Service will continue to be payable. You acknowledge that canceling your subscription is your sole recourse for any dissatisfaction, issues, or concerns related to your subscription, its content or features, these Terms of Service, including Subscription Fees, applicable taxes, billing methods, content selection, privacy policy, changes thereto, or any other subscription policies or practices.
